After you have formed your positions on the various matters, it is time for a second meeting in which you will provide us with all the information regarding your wishes. You will indicate your choice of who will serve as your future attorney-in-fact, and clearly and comprehensively detail all the relevant instructions by which the appointed representative will operate when required.

First, we will meet and get to know each other. You will receive a detailed and comprehensive explanation regarding the implications of signing a Continuing Power of Attorney, as well as the various mechanisms available within the document.

The lawyer will sign the Continuing Power of Attorney and verify your signature as well as the signatures of the appointed representatives. Afterwards, the lawyer will submit the Continuing Power of Attorney through the online system to the Office of the Public Guardian. The document will be reviewed, and an official confirmation of its receipt and deposit will be sent to our office.

You arrive for the formal signing of the Continuing Power of Attorney. During the signing meeting, we will go through the document together to ensure that no errors or inaccuracies are present. You will be asked to read it, confirm its contents, and sign it.

The law stipulates that only a lawyer who has been certified by the Office of the Public Guardian, after completing a dedicated and specialized training program, is permitted to practice as a continuing power of attorney lawyer. A continuing power of attorney is a special legal document that must be drafted in accordance with statutory requirements and guidelines, and exclusively by a lawyer who has undergone the appropriate training and certification.

The control remains in our hands and is not transferred to the court's authority. It is a simple process that prevents complicated bureaucracy with the court and eases the burden on the appointed representative (often a family member). We choose ourselves who will take care of our affairs in the event of loss of capacity. It allows us to decide when and under which circumstances the appointment will take effect.
